General conditions of Renault InfoTech site access and use

The present conditions of Internet site access and use developed and opened by RENAULT and accessible at the address: www.infotech.renault.com ("Renault InfoTech" or the "Site") are designed to define the legal and general conditions ("GCAU"), which govern the Site use by any car repair professionals, which exercise their professional repair activity within the European Economic Space, which are registered to the Site and which undertake to respect the aforementioned GCAU (" User").

The Site offers the User a range of products/services:
  • consulting Technical Information online, and/or
  • ordering products for which the description features on the Site (CDRoms, technical documentation, repair manuals, wiring diagrams, etc.),
  • hereinafter referred to together as the "Services" and the supply of these services is also subject to Supply Conditions of the products and services of the Renault InfoTech site enclosed, which are an integral part of the GCAU ("SCRI").

    As already mentioned the Technical Information obtained via the Site is for the carrying out of repair and maintenance work on RENAULT vehicles exclusively by car repair professionals, which have the skills and tools necessary to carry out this work. RENAULT cannot be held liable for repair and maintenance work on vehicles carried out, those that carried out the work are solely and fully liable.

    The use of Technical Information obtained via the Site is governed by the Conditions of Technical Information use enclosed, which are an integral part of the GCAU ("CTIU").

    1. General Information

    2. Services Description
    The detailed description of Services features on the Site. RENAULT reserves the right to modify the Services and information, which feature on the Site, at any moment, without any notice, taking into account Site interactivity, without this involving the liability of RENAULT.

    3. Registration and Access to the Site
    So as to make access and use of the Site possible, the car repair professional interested should fill out the on-Site registration form and accept without reservation the present GCAU, after reading them. This form should be completed fully and in good faith, by only supplying useful and truthful information. RENAULT reserves the right, without any notice, of cancelling definitively the access to the Site from the moment that The User concerned supplies incomplete or inexact information.

    After having given and validated the information demanded, The User will receive at his or her email address indicated an identifier and password, enabling access to the Site and Services available on the day of the connection (warning, only one User account per email address.).

    The User undertakes to :
  • be liable for his or her identifier and password security and/or use,
  • not make known his or her identifier or his or her password to a third party,
  • not authorise any other natural person or legal entity to use his or her identifier or password,
  • use the Site in conformity with the GCAU.


  • The User is solely and uniquely responsible for his or her password and his or her identifier, and of any Site use or access which could result from their use. RENAULT undertakes to check the validity of the identifier and password. RENAULT is not liable for checking the identity of the person accessing the Site via the aforementioned User password and identifier.

    The User should obtain at his or her own costs the equipment, software and telecommunication services necessary for access to the Site and for use of the Services. The User should immediately inform RENAULT of any fraudulent use of his or her password and disconnect after each consultation of the Site.

    4. Site Availability
    Access to the Site is possible 24 h / 24 h, 7 days / 7 days, except in the case of absolute necessity. It is expressly agreed that RENAULT will be able to, from time to time, interrupt, limit, suspend, forbid, totally or partly the access to the Site or the Services in order to carry out operations involving maintenance, updates or in order to solve technical problems relating to the servers, networks or software, or because of the fault of a third party service supplier. RENAULT will also be able to and at any time modify, add or delete one of the Services and will endeavour to inform the Users about this.

    RENAULT will do its best to maintain defined levels of security with regard to the authentication mode defined above.

    The User acknowledges nevertheless that the public nature of the Internet makes it impossible for RENAULT to guarantee that each User will be able to access at any time the Site or one of the Services during the period of Site availability and the opening time particular, if the need arises, to each Service and that this access will not be interrupted, that it will be exempt from error or from any unauthorised breaches in security.

    The User acknowledges that neither RENAULT nor its suppliers are liable for damages as a result of the interruption, the suspension, or modification or neglected state of the Site or one of the Services.

    5. Intellectual property rights
    5.1. Copyright and/or Copyright with regard to Designs and Models
    RENAULT owns the copyright of the present site according to the articles L. 111.1 and following the intellectual property Code. The photographs, texts, slogans, designs, images, animated sequences either with or without sound, as well as any pieces of work integrated into the site are the property of RENAULT or the third party, which has authorised RENAULT to use them. Vehicle models represented on the site are protected by copyright and the articles L.511.1 and according to the intellectual property Code relating to the protection of registered models. The reproductions, in paper or electronic form, of the aforementioned site and the pieces of work and vehicle models which are reproduced on this site are authorised, on condition that they are strictly reserved for personal use, which excludes any usage for advertising and/or commercial and/or information purposes and/or that they are in conformity with the provisions of the article L122-5 of the intellectual property Code. With the exception of the provisions above, any reproduction, representation, use or modification, by whatever process and in whatever medium, of any or part of the site, of any or part of the different pieces of work and vehicle models that make up the site, with no prior authorisation from RENAULT, is strictly forbidden and constitutes an infringement of copyright punishable by two years imprisonment and a fine of 150,000 Euro.

    5.2. Trademark copyright
    The RENAULT name, the RENAULT logo (diamond), the name of the vehicles in the RENAULT range and associated products and services, are trademarks registered by RENAULT. Other trademarks are also cited; they are in principle identified by a capital letter. They are used by RENAULT either with the authorisation of their trademark holder, or as a simple indication of products or services offered by RENAULT. The reproduction, imitation, use or insertion of these trademarks without prior authorisation from RENAULT or their respective trademark holders constitutes an infringement of copyright punishable by two years imprisonment and a fine of 150,000 Euro.

    6. Guarantees, liabilities and liability limitations
    6.1. The User:
    The User undertakes to respect the provisions of the present conditions, any rules governing the activities on the Site and the use of Services and Technical Information as well as any laws and internal and international regulations in force applicable to the activities of the User on, via or related to the Site.

    The User notably undertakes not to :
  • infringe the provisions of the GCAU;
  • use the Site and the Services in a fraudulent or illegal way or without authorisation;
  • use the Site and its Services in violation of the intellectual property laws, applicable rules and prescriptions defined by RENAULT;
  • use the Site in a way which makes it difficult for or stops the access of other Users;
  • infringe RENAULT intellectual property rights;
  • delete, mask or deface a note which mentions copyright, a trademark or notes which mention property rights added to or contained on Site and in its Services;
  • make possible the disclosure or the reproduction without authorisation of a part of the Site or information obtained via the Site;
  • authorise access to the Site or to one of its elements, or their use, by or for a third party;
  • create on other Web sites frames which use pieces of information obtained via the Services or which are related to the Services;
  • supply or create links with the Site;
  • carry out or authorise schemes which contravene the provisions of the GCAU and which involve the Site and/or its Services.


  • The User should compensate and insure RENAULT against any actions, compensation demands or damages which ensue from or which are related to an action or an omission by The User or which ensue from or which are related to the use of the Site or the Services.

    6.2. RENAULT:
    RENAULT undertakes with regard to the User with due care and attention to do everything to make sure that the access and use of the Site and the Services is implemented in conformity with the description of the aforementioned Services, such as which figure on the Site and the laws and regulations in force.

    The Site can contain links or references to other Web sites and other e-commerce sites. RENAULT is not liable for the content of these other Web sites and is not liable for damages of any nature, direct or indirect, caused by the content displayed on these other Web sites or accessible via these other Web sites.

    The content published on the Site by RENAULT can include technical inaccuracies or misprints. It can be modified at regular intervals, but also when RENAULT wishes. RENAULT endeavours to warn The User of modifications to content published by RENAULT.

    The User acknowledges that the content published on the Site by RENAULT is for information purposes only, of a general nature and incomplete. RENAULT does not guarantee that the content published on the Site by RENAULT will be appropriate to the needs of The User.

    The User undertakes to make use of the content published on the Site by RENAULT and takes sole liability for its use and in conformity with the GCAU. Consequently, RENAULT cannot be held liable for any direct or indirect damages caused to The User or to a third party, which result from the use made by The User of the content published on the Site by RENAULT.

    The Site and the Services are supplied in the present condition and according to their availability, and The User acknowledges that neither RENAULT nor its suppliers are liable for damages as a result of, notably, the interruption, the suspension, the modification of the Site or one of its elements, or that the Services are not appropriate to the needs of the User.

    Taking into account the level of security of the Site, RENAULT will not be held liable for fraudulent access to the Site constituting an offence which comes under articles 323-1 and according to the Criminal Code.

    RENAULT can, given the circumstances, take any measures which it deems necessary or appropriate with regard to the use of the Site and of its Services by The User. Notably, RENAULT can interrupt, limit, suspend, forbid, totally or partly the access to the Site or to the Services, without notice or compensation, if The User behaves in a way or is involved in activities forbidden by the laws and regulations in force or the present GCAU.

    7. Information Technology and civil liberties
    Personal information which The User is asked for at the signature of the order form are necessary for the transaction and will be subject to computer processing by RENAULT. It will only be subject to communication to the third party mentioned on the registrations carried out at the National Commission for Information Technology and Civil Liberties for reasons of administrative management of the transactions and Client Service or in order to satisfy legal obligations or regulations. In conformity with the right of access defined by the "Information Technology and Civil Liberties" law n° 78-17 of 6 January 1978, The User will be able at any time to verify the accuracy, ask for the correction or demand the deleting of this information by sending an email to : webmaster.infotech@renault.com.

    RENAULT may obtain information collected automatically but which cannot be associated to a person. This information concerns the type of Internet browser utilised by The User, the operating system of his or her computer and the name of the domain via which he or she accessed the Site.

    During the visit to the Site, RENAULT may insert a cookie on the computer of The User. A cookie is a small block of data sent to the browser by a web server and stored on the computer hard disk . The cookie does not make it possible for RENAULT to personally identify The User. Generally speaking, it enables RENAULT to register information relating to computer browsing on the Site (the pages consulted, the date and the hour of the consultation, etc.) that RENAULT will be able to read during the User's next visits. The User can of course oppose the registering of cookies by configuring his or her browser following the editor's specifications. The User can also delete the cookies at any time and individually by referring to the computer user guide.

    8. Audit rights
    As long as The User is warned in due time and during normal working hours RENAULT has the right to carry out a periodic audit concerning the use of the Site made by The User, on condition that the confidentiality clauses of the present conditions are respected, in order to ensure that The User respects the present GCAU.

    9. End of access rights to the Site
    RENAULT can, at any time and as it wishes, definitively suspend, limit, or forbid, the Users access to the Site :
  • in the case of breach by The User, after formal notice put into effect immediately addressed by RENAULT by registered letter with acknowledgement of receipt to The User,
  • if The User behaves in a way or is involved in activities forbidden by the laws and regulations in force or the present GCAU.


  • In the case of access suspension, limitation or ban, any rights granted by the present conditions to The User are ended and The User should immediately stop using the Site, without prejudice to damages for RENAULT.

    The termination of the present conditions is without prejudice to any provisions of the present conditions, which should continue in force despite this termination.

    10. General Provisions
    10.1. Transfer
    The User cannot transfer any of the rights or obligations that he or she has contracted according to the terms of the present conditions without prior written authorisation by RENAULT.

    10.2. Relinquishment of a right
    The fact that a party does not assert or delays asserting a right, a power or a prerogative acknowledged by the present conditions cannot be interpreted as relinquishment of this right, this power or this prerogative. The relinquishment of a right is only effective if it is established by a written document signed by the party which is affected by this action.

    10.3. Notifications – Official assignations
    All notification or official assignation in accordance with the present GCAU should be sent by email or by fax and confirmed by registered letter with acknowledgement of receipt.

    10.4. Language
    The present GCAU are written in French. This language prevails over any translations in other languages.

    10.5. Choice of place of residence
    For the carrying out of the present GCAU and their consequences, each Party chooses its registered office as its official residence.

    10.6. Autonomy of provisions
    The fact that one of the provisions of the present conditions is totally or partially invalid or inapplicable does not invalidate are does not make other provisions of the present conditions inapplicable with regard to the laws and the regulations currently in force.

    10.7. Force Majeure
    They are expressly considered as cases of absolute necessity, besides those usually retained by the jurisprudence of French courts, such as notably internal and external company strikes, bad weather, government and legal restrictions and modifications in marketing conventions, computer breakdown and telecommunication block, the degradation of RENAULT servers, and any other cases independent of the express wish of RENAULT.

    The occurrence of a case of absolute necessity will lead to the suspension, to begin with, by rights, of the carrying out of the present GCAU. If, after a period of 3 months, RENAULT and The User note the persistence of the case of absolute necessity, the GCAU will be terminated automatically and by rights unless otherwise agreed upon between RENAULT and The User.

    11. Applicable legislation – Jurisdiction assignment clause
    The GCAU and any rights and duties of the parties generated by or related to the Site are subject to French legislation and are interpreted and applied in conformity with this legislation. All lawsuits concerning the GCAU will be subject to the exclusive jurisdiction of the competent PARIS courts to whom the parties acknowledge the exclusive power to give a verdict, notwithstanding the multiplicity of the defendant parties or the compensation demands from the third party. The User should present to the competent PARIS court any claims ensuing from or related to the GCAU, or which are related to the Site, within the delay of one (1) year from the date on which this claim was made on pain of seeing it abandoned and definitively rejected.

    12. GCAU Update
    RENAULT reserves the right to modify and update at any time the access to the site as well as the GCAU. These modifications and updates are imposed on The User who should in consequence refer regularly to this heading in order to verify the applicable GCAU.

    2. Field of application
    The present Supply Conditions of Renault InfoTech products and services ("SCRI") are applied to any online transactions concluded on the Renault InfoTech site ("Site") and which are designed to define the contractual relations between the RENAULT company and each professional car repair client who exercises his or her professional repair activity within the European Economic Space (the "Client").

    As already mentioned the Technical Information obtained via the Site is for the carrying out of repair and maintenance work on RENAULT vehicles exclusively by car repair professionals, who have the skills and tools necessary to carry out this work. RENAULT cannot be held liable for repair and maintenance work on vehicles carried out, those that carried out the work are solely and fully liable.

    The use of Technical Information obtained via the Site is governed by the Conditions of Technical Information use enclosed, which are an integral part of the SCRI ("CTIU").

    3. Presentation of products/services offers and corresponding prices
    The Site offers the Client a range of products/services which allow the Client to consult online the Technical Information and/or order products which are described on the Site (CDRoms, technical documentation, repair manuals, wiring diagrams, etc.).

    The package validity delay runs from the date of the first consultation carried out by the Client, noted by RENAULT, whatever the day of the package subscription. Example: If the Client subscribes the day "d" to a "package 1" of one hour, and he or she carries out his or her first consultation the next day at 10 am, the package will be valid for 1 hour and the Client will be able to consult the Technical Information from 10 am to 11 am (local time), date on which the delay will expire.

    The package validity does not take into account the real time of connection. Consequently, it is for the Client to correctly evaluate the appropriateness of the aforementioned packages to his or her needs with regard to both the nature of the Technical Information desired and the delay granted in order to consulter this Information.

    4. Client acceptance
    All purchase orders for product which feature on the Site implies prior consultation and acceptance by the Client of the present SCRI, the Conditions of Use of RENAULT Technical Information ("CUIT"), as well as the General Conditions of Access and Use of the Site ("GCAU"). If the Client ticks the box "I accept the present Supply Conditions of Renault InfoTech Products and Services" and confirms the purchase order by clicking on the button "I order" this implies a full and complete acceptance of the aforementioned contractual documents, which will only be applicable to the purchase order placed in this way.
    Contractual information is presented in the French language and will be subject to a recapitulative confirmation from the date of payment and at the latest to the time of delivery.

    5. Availability of products and services
    Products and services offers and prices are valid as long as they are visible on the Site, while stocks last. When products are unavailable after purchase order placement, the Client will be informed by email or by post as soon as possible, and the client's bank account which corresponds to the bank card used for the transaction will be recredited by an amount equal to the sum debited on the transaction date. If there is no reimbursement within a delay of ten (10) working days, the Client is invited to inform the Client Service by email at the following address : webmaster.infotech@renault.com.

    Purchase order execution will be suspended by RENAULT or by the Client when there is a case of absolute necessity, such as those defined in the present conditions.

    6. Price
    The price of products and services ordered is that which features on the Site at the date of purchase order placement. These prices do not take into account delivery costs which will be billed as an additional charge. All purchase orders are payable in Euros.

    The prices can be modified at any time without notice, the User should be aware that the articles will be billed on the basis of the price in force at the time of the purchase order registration, on condition of availability.

    The purchase order should be paid in advance by bank card. The account which corresponds to the bank card used for the transaction will be debited at the time of the purchase order validation by the Client.

    So as to finalise the transaction, the Client connects to a secure Site which, after the Client documents the necessary information, will or will not accept the means of payment. The Client declares that he or she has been informed that information confidentiality and transaction security (bank card number) are ensured by an SSL encryption procedure in conformity with professional standard practices.

    7. Delivery
    Site products can only be delivered to European Economic Space countries.

    The products are delivered to the delivery address that the Client indicated during the ordering process.

    The delays indicated are average delays and correspond to the delays in process and delivery. As from the effective purchase order payment, the average delivery delay noted is fifteen (15) working days. This delay is given for information purposes only and RENAULT will not be liable if this delay is exceeded. Nevertheless, in the case of delay, an email will be addressed to the Client.

    Any purchase order not sent within the 30 (thirty) days which follow the purchase order date is cancelled unless otherwise stipulated and made clear in the sales offer.

    RENAULT reserves the right to cancel any purchase order by a Client with whom there is a lawsuit relating to the payment of a previous purchase order.

    8. Ownership and risk transfer
    The transfer of the ownership of products and services covered by the purchase order to the Client will only be carried out after complete payment of the price by the Client. On the other hand, the transfer of risks of product loss and degradation are implemented immediately from their delivery and receipt at the address mentioned by the Client in the purchase order.

    9. Guarantee and Liability
    The products delivered and services supplied are in conformity with the specifications described on the Site, as well as French and community legislation in force. RENAULT cannot be held liable if the legislation of the country is not respected where the products or services are ordered and/or used.

    The only guarantee agreed to by RENAULT concerns the supplying of a service which procures for the Client the product ordered without giving any guarantee concerning the actual quality and content. RENAULT does not give any guarantee, which notably concerns the appropriateness of the products and services to the needs of the Client. RENAULT will not be liable to the Client for indirect, consequential, special, accessory, dissuasive damages, information loss or problem which arise during electronic payment, costs linked to a delay or the obtaining of substitute products or services, whatever the cause, which results from the present contract.

    The RENAULT guarantee only applies to the replacement or reimbursement of products acknowledged as defective or not in conformity with the description on the Site. In any case, the alleged failure to conform will have to be established, if necessary after examination by RENAULT of the offending product. No return of product will be accepted without prior and written agreement of RENAULT.

    The Client's attention is drawn to the fact that RENAULT is not the owner of the secure electronic transaction and payment online service and is cleared by this fact from any liability in this respect.

    Only the Client is liable for effective payment of the product purchased. Only the Client is liable for payment by bank card of the products ordered. RENAULT is not liable for payment problems linked to the functioning of the e-commerce service.

    Indeed, the information that the Client obtains as part of the services proposed by RENAULT, either on the Site, by email or in the form of a text message, do not give the rights to any guarantee by RENAULT beyond those stipulated in the present GCU. The Technical Information is made available to the Client by RENAULT "in the present condition" and should be used by the Client in conformity with the provisions of the CUIT.

    The Client acknowledges that RENAULT will not be held liable if there is a delay or a cancellation of a purchase order due to stock shortage at the publishers' or if there is an error in the presentation of the products.

    10. Reimbursement - Return
    The Parties agree that RENAULT will not carry out any product exchange.

    RENAULT undertakes with regard to the Client to reimburse the products that do not correspond to the purchase order, which are not in conformity with the specifications described or defective. In return, the Client undertakes to write a detailed report concerning the problems and to send back the product or products to the following address: EURODISPATCH Chécy . The products should be sent back to the aforementioned address in good condition or in the condition in which it was delivered, accompanied by a copy of the invoice and the delivery slip. RENAULT will carry out the reimbursement of the product or products according to the conditions given hereinafter.

    No reimbursement will be carried out in the absence of a failure to conform or a defect noted in the conditions described in the article 10 "Guarantee and Liability".

    In the case of reimbursement linked to a failure to conform or a defect duly noted, mailing costs will be chargeable to RENAULT.

    The reimbursement will be carried out within a delay of less than or equal to ten (10) working days after the receipt of the products by RENAULT. In this case, the account debited which corresponds to the bank card used for the transaction will be recredited by an equivalent amount. No mail in return will be accepted, whatever the motive.

    11. Information Technology and civil liberties
    Personal information which The Client is asked for at the signature of the purchase order is necessary for the transaction and will be subject to computer processing by RENAULT.     13. Contract of Evidence
    The computerised registers conserved on the RENAULT computer systems under reasonable security conditions will be considered as evidence of the transactions carried out by the Client on the Site. The stocking of data is carried out on a durable and reliable medium in such a way as to correspond to a durable and faithful copy in conformity with the article 1348 of the Code Civil. In the case of conflict between the RENAULT computerised registers and any document in written medium or electronic file of the Client, it is expressly agreed that the RENAULT computerised registers will take precedence over the Client documents and will only be accepted by way of evidence.

    Any order form signed by "click" constitutes an irrevocable acceptance that cannot be challenged apart from the cases envisaged in the present SCRI.

    The parties acknowledge that the"click" procedure associated to the authentication and non-repudiation procedure and to message integrity protection constitutes an electronic signature. This electronic signature has the same value between the parties as a written signature.

    14. Audit rights
    As long as The Client is warned in due time and during normal working hours RENAULT has the right to carry out a periodic audit concerning the use of the Site made by The Client, on condition that the confidentiality clauses of the presents conditions are respected, in order to ensure that The Client respects the present SCRI.

    15. Termination of the present SCRI and/or the orders
    RENAULT has the right to terminate or suspend the SCRI and/or the orders in the case of breach by the Client within 15 days following formal notice addressed by RENAULT by registered letter with acknowledgement of receipt to the Client and which has had no effect.

    In the case of termination of the SCRI, any rights granted by the present conditions to The User are ended and The User should immediately stop using the Site, without prejudice to damages for RENAULT.

    RENAULT can also, at any time and as it wishes, suspend, limit, or forbid, the Clients access to the services according to the conditions of the GCAU.

    16. General Provisions
    16.1. Transfer
    The Client cannot transfer any of the rights or obligations that he or she has a contracted according to the terms of the present conditions without prior written authorisation by RENAULT.

    16.2. Relinquishment of a right
    The fact that a party does not assert or delays asserting a right, a power or a prerogative acknowledged by the present conditions cannot be interpreted as relinquishment of this right, this power or this prerogative. The relinquishment of a right is only effective if it is established by a written document signed by the party which is affected by this action.

    16.3. Notifications – Official assignations
    All notification or official assignation in accordance with the present SCRI should be sent by email or by fax and confirmed by registered letter with acknowledgement of receipt.

    16.4. Language
    The present SCRI are written in French. This language prevails over any translations in other languages.

    16.5. Choice of place of residence
    For the carrying out of the present SCRI and their consequences, each Party chooses its registered office as its official residence.

    16.6. Autonomy of provisions
    The fact that one of the provisions of the present conditions is totally or partially invalid or inapplicable does not invalidate are does not make other provisions of the present conditions inapplicable with regard to the laws and the regulations currently in force.

    16.7. Force Majeure
    They are expressly considered as cases of absolute necessity, besides those usually retained by the jurisprudence of French courts, such as notably internal and external company strikes, bad weather, government and legal restrictions and modifications in marketing conventions, computer breakdown and telecommunications block, the degradation of servers, and any other cases independent of the express wish of RENAULT.

    The occurrence of a case of absolute necessity will lead to the suspension, to begin with, by rights, of the carrying out of the present SCRI. If, after a period of 3 months, RENAULT notes the persistence of the case of absolute necessity, the SCRI will be terminated automatically and by rights unless otherwise agreed upon between RENAULT and the Client.

    17. Applicable legislation – Jurisdiction assignment clause
    The SCRI and any rights and duties of the parties generated by related to the Site are subject to French legislation and are interpreted and applied in conformity with this legislation. All lawsuits concerning the SCRI will be subject to the exclusive jurisdiction of the competent PARIS courts to whom the parties acknowledge the exclusive power to give a verdict, notwithstanding the multiplicity of the defendant parties or the compensation demands from the third party . The Client should present to the competent PARIS court any claims ensuing from or related to the SCRI, or which are related to the Site, within the delay of one (1) year from the date on which this claim was made on pain of seeing it abandoned and definitively rejected.

    18. General conditions update
    RENAULT reserves the right to modify and update at any time the access to the site as well as the SCRI. These modifications and updates are imposed on The Client who should in consequence refer regularly to this heading in order to verify the applicable SCRI.

    Conditions of RENAULT Technical Information use

    1. Objective
    The present licence is designed to determine the conditions in which RENAULT grants the professional car repair client who exercises his or her professional repair activity within the European Economic Space (hereinafter named "the Client") the right to use the Technical Information according to the definition which is given in the Regulation (EC) n° 1400/2002 RENAULT company ownership.

    2. Field of application - RENAULT Technical Information Ownership
    As already mentioned numerous elements make up the total or a part of the RENAULT Technical Information to which the Client can have access either by means of the online consultation service or by means of the online ordering service :
    • resulting from know-how developed by RENAULT ;
    • protected by the legislation on copyright, such as notably articles, photographs, plans, designs, software, CDRoms, databases ;
    • and/or protected by the legislation on designs and models such as notably vehicle models ;
    • protected by the legislation on trademarks, such as the trademark "RENAULT", the logo "Diamond" as well as all vehicle model names in the RENAULT range.
    By using the Technical Information the Client acknowledges that the aforementioned information is protected by an ownership right exclusive to RENAULT or a third party, which has authorised RENAULT to make use of this information.

    3. Area covered by RENAULT Technical Information use licence
    3.1. Geographical area
    The authorisation to use the RENAULT Technical Information in conformity with the provisions of the present conditions is only valid for the European Economic Space.

    3.2. Authorisation duration
    The duration of the present authorisation to use the RENAULT Technical Information is granted in conformity with the provisions defined in the hereinafter mentioned Articles 3.3 and 3.4. If the terms and conditions of the present authorisation are not respected, RENAULT reserves the right to end the authorisation at any time and without notice.

    3.3. Right to use RENAULT Technical Information accessible via the online consultation Service
    RENAULT grants the Client the non-exclusive right to use RENAULT Technical Information accessible on the online Consultation Service according to the conditions hereinafter defined: In return for the payment of the price defined on the Order Form, RENAULT authorises the Client to visualise, download and print the Technical Information during the time which corresponds to the package paid for, as defined in the General Supply Conditions of products and services and to use them with no duration limit for the sole purpose of his or her repair and maintenance activity of RENAULT vehicles.

    3.4. Right to use RENAULT Technical Information accessible via the online ordering Service
    RENAULT grants the Client the non-exclusive right to use RENAULT Technical Information accessible on the online ordering Service according to the conditions hereinafter defined: In return for the payment of the price defined on the Order Form, RENAULT authorises the Client, with no duration limit, to use the RENAULT Technical Information that the Client receives in the form of paper medium or CDRoms with the sole purpose of his or her repair and maintenance of RENAULT vehicles. The authorisation thus granted does not extend to eventual updates of documents delivered.

    3.5. Authorisation limits
    Any use of RENAULT Technical Information outside the provisions of the Articles 3.3 et 3.4 of the present conditions is strictly forbidden without the prior authorisation of RENAULT.

    Consequently, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, partial or complete by whatever procedure and using whatever medium (paper, digital, …) of RENAULT Technical Information outside of the authorisation envisaged in the aforementioned Articles 3.3 and 3.4 is forbidden without prior written authorisation of RENAULT, subject to the exceptions which are noted in the article L122.5 of the Intellectual Property Code, on pain of constituting a copyright and/or design and model and/or trademark infringement, punishable by two years imprisonment and a fine of 150,000 Euro.

    As already mentioned the aforementioned Technical Information is for the carrying out of repair and maintenance work on RENAULT vehicles exclusively by car repair professionals which exercise their activity within the countries covered by the geographical area of the present licence, and which have the skills and tools necessary to carry out this work. Consequently, any use of RENAULT Technical Information for other purposes and/or by other persons apart from the aforementioned persons and/or outside the geographical area covered by the present conditions is forbidden and implies prior authorisation of RENAULT.     4. Liability and guarantee
    4.1. RENAULT is not liable for repair and maintenance work on vehicles carried out, those that carried out the work are solely and fully liable.

    4.2. The Client is solely and fully liable for the use he or she makes of the RENAULT Technical Information. RENAULT assumes no liability in the case of a third party action, claim and/or demand whatever their nature which could be undertaken against the Client as a result of the use of RENAULT Technical Information. As such, the Client is forbidden to implead RENAULT, following his or her implication and/or his or her sentencing as part of a third party action, claim an/or demand that he or she would be subjected to as a result of the use of RENAULT Technical Information.

    4.3. The Client undertakes besides to insure RENAULT against any third party action, claim and/or demand whatever their nature that RENAULT could be subjected to as a result of the use of RENAULT Technical Information outside the authorisation which is expressly granted to the Client by the present provisions.

    5. Intuitu personae
    The present authorisation is consented to by the Client considered as a person (intuitu personae). Consequently, the Client can neither transfer nor assign the authorisation.

    The CTIU and any rights and duties of the parties generated by or related to the Site are subject to French legislation and are interpreted and applied in conformity with this legislation. All lawsuits concerning the CTIU will be subject to the exclusive jurisdiction of the competent PARIS courts to whom the parties acknowledge the exclusive power to give a verdict, notwithstanding the multiplicity of the defendant parties or the compensation demands from the third party . The Client should present to the competent PARIS court any claims ensuing from or related to the CTIU, or which are related to the Site, within the delay of one (1) year from the date on which this claim was made on pain of seeing it abandoned and definitively rejected.
